Situations could arise where Citizenship and Immigration Canada receives work permit applications after the ESDC has suspended the relevant opinion. In these situations, Citizenship and Immigration Canada officers would need to suspend the processing of the work permit application. This is in accordance with the Ministerial Instructions.
There could be situations where foreign nationals:
- Are already working in Canada and,
- Have submitted an application to extend their work permit
In this case, these foreign nationals could obtain an implied status if they submitted their applications for extension, prior to the expiry of their current work permit.
This means that these foreign nationals:
- Could continue to remain in Canada
- Could continue to work for the same employer listed on their original work permit
These foreign nationals would continue to have an implied status until the authorities take a final decision on the applications of these foreign nationals.
