Change in Procedures for Processing Quebec Family Class Applications – Modified
Summary
This Operational Bulletin (OB) provides information on the change in procedures for Quebec family class applications. In particular, it concerns the applications implemented by the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) on March 25, 2011.
These changes are applicable to those applications, where a sponsor:
- Lives in the province of Quebec or abroad (where applicable) and,
- Meets the federal requirements prescribed for sponsoring a member of the family class
Issue
This OB provides operational instructions on the changes in procedures. The Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) is responsible for implementing these procedures for family class applications.
The change applies to those applications, where a sponsor:
- Lives in the province of Quebec or abroad (where applicable) and,
- Meets the federal requirements prescribed for sponsoring a member of the family class
The change also applies to cases where the sponsor:
- Is a Canadian citizen, residing outside of Canada and,
- Is sponsoring:
- A spouse or,
- A partner and / or,
- A dependent child
- Who intend to reside in Quebec upon their return to Canada
These changes come into effect from March 25, 2011.
Background
At present, the Case Processing Centre in Mississauga (CPC-M) receives applications where the sponsor:
- Lives in Quebec or is destined to Quebec and,
- Meets the federal eligibility requirements
On receiving such cases, the Case Processing Centre in Mississauga (CPC-M) sends a copy of the undertaking application i.e. IMM 1344EA, directly to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI). Readers must note that the applicant does not send a copy of the undertaking application i.e. IMM 1344EA, directly to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI). This is the current process.
The Case Processing Centre in Vegreville (CPC-V) and the inland offices forward the IMM 1344 and the IMM 5001 to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) currently, if the sponsor:
- Resides in Quebec
- Meets the minimum federal requirements and,
- Is sponsoring a spouse or a common-law partner from within Canada
The Instructions
The instructions for the changes in procedure follow.
At the Case Processing Centre in Mississauga (CPC-M)
- The Case Processing Centre in Mississauga (CPC-M) will send a letter to the sponsor
- The letter will instruct the sponsor to:
- Download the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit
- Complete the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit and,
- Submit the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI)
- Include a copy of the letter issued by the Case Processing Centre (CPC) along with the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit
- However, the Case Processing Centre in Mississauga (CPC-M) will only do this if it receives an application, where the sponsor:
- Resides in the province of Quebec and,
- Meets the federal requirements prescribed for sponsoring a member of the family class
- The Case Processing Centre in Mississauga (CPC-M) will only send a copy of the IMM 1344EA directly to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) for adoption cases
- The Case Processing Centre (CPC) has the authority to send an electronic version of the IMM 1344 to garants.dsiq@micc.gouv.qc.ca
- The Case Processing Centre in Mississauga (CPC-M) will send a letter to the sponsor
- The letter will instruct the sponsor to:
- Download the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit
- Complete the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit and,
- Submit the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI)
- Include a copy of the letter issued by the Case Processing Centre (CPC) along with the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit
- However, the Case Processing Centre in Mississauga (CPC-M) will only do this if it receives an application, where the sponsor:
- Decides to add a family member to their application during processing (such as a newborn dependent) or,
- Changes a non-accompanying family member to an accompanying family member
At Visa Offices
- The Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) will continue sending decisions on undertaking application to visa offices in the usual manner
- The visa officer would need to ask the principal applicant to provide the missing Certificat de Sélection du Quebec (CSQ), if the visa officer finds that:
- The authorities have approved the undertaking application and,
- The Certificat de Sélection du Quebec (CSQ) is missing for one or more persons included in the application
- The visa office would need to contact the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) directly to request for a Certificat de Sélection du Quebec (CSQ)
- The visa office can contact the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) directly at garants.dsiq@micc.gouv.qc.ca
- However, the visa office would only contact the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) directly in cases where:
- The sponsorship application has not met the federal requirements and,
- The sponsor decides to continue the processing of the application
At the Case Processing Centre – Vegreville (CPC-V), Backlog Reduction Office (BRO) and local Citizenship and Immigration Canada (CIC) Offices
- The Citizenship and Immigration Canada (CIC) office will send a letter to the sponsor
- The letter will instruct the sponsor to:
- Download the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit
- Complete the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit and,
- Submit the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI)
- Include a copy of the letter issued by the Case Processing Centre (CPC) along with the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit
- However, the Citizenship and Immigration Canada (CIC) office will only do this for FC1, FCC and FCH cases
- It is no longer necessary for the Citizenship and Immigration Canada (CIC) office to forward a copy of the IMM 1344 or the IMM 5001 to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI)
- The Citizenship and Immigration Canada (CIC) office will send a letter to the sponsor
- The letter will instruct the sponsor to:
- Download the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit
- Complete the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit and,
- Submit the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI)
- Include a copy of the letter issued by the Case Processing Centre (CPC) or Citizenship and Immigration Canada (CIC) or the Backlog Reduction Office (BRO) along with the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI) undertaking kit
- However, the Citizenship and Immigration Canada (CIC) office will only do this if it receives an application, where the sponsor:
- Decides to add a family member to their application during processing (such as a newborn dependent) or,
- Changes a non-accompanying family member to an accompanying family member
- The Citizenship and Immigration Canada (CIC) office will forward a copy of the following documents to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI):
- The IMM 1344
- The IMM 5001 and,
- The transmission
- However, the Citizenship and Immigration Canada (CIC) office will only do this for Humanitarian and Compassionate (H&C) applications with sponsorship (HC2)
- In all other incidences, the CIC does not need to forward the above-mentioned documents to the Quebec Ministère de l’Immigration, de la Diversité et de l’Inclusion (MIDI)
Officers might encounter situations where they would need to access further information outlined in this OB. In such cases, the officers would need to contact:
- Their supervisors or,
- Their Regional Program Advisors (RPAs)
