It is worth mentioning that former Canadian citizens or former permanent residents could request permanent resident status on humanitarian and compassionate (H&C) grounds as well. As is the case with all applications, the officers would need to consider cases involving former Canadian citizens or permanent residents on their individual merits.
The following guidelines might be of some help to the officers, even though they are not exhaustive. The officers would need to:
- Ensure that the applicant:
- Was a Canadian citizen who has lost their citizenship
- If necessary, the officers would need to confirm the loss of citizenship with the Case Processing Centre (CPC) Sydney
- In the request, the officers would need to specify:
- The applicant’s name
- The applicant’s date of birth and,
- The applicant’s country of birth
- Was a permanent resident who has lost that status
- If necessary, the officers would need to confirm the loss of citizenship with the Case Processing Centre (CPC) Sydney
- Has exhausted all the options available before requesting for permanent resident status on humanitarian and compassionate (H&C) grounds
- Was a Canadian citizen who has lost their citizenship
- Consider the following factors in case the applicant is not a Canadian citizen and has exhausted all the other options available
- The circumstances under which the applicants lost their Canadian citizenship or permanent resident status
- This includes determining whether the applicants would have lost their Canadian citizenship or permanent resident status under the provisions of the present Act
- The hardship that the applicant would experience if the authorities were to refuse the application
- The situation of the family members in Canada
- The presence of any strong cultural and / or emotional ties to Canada
- The presence of any close relatives, friends and support in another country and,
- The degree of establishment in Canada
- The circumstances under which the applicants lost their Canadian citizenship or permanent resident status
