February 16, 2017 — In the latest immigration.ca livestream, Canada immigration lawyer Colin Singer answers your specific case-related questions on immigrating to Canada.
We receive several questions each time a new livestream video goes out, so this episode is dedicated to answering some of those queries.
For every question submitted, we are sure there are hundreds more out there, so please do not be afraid to follow us on Facebook and submit a question during our next livestream.
This Canada immigration question and answer includes a query about whether there is a need to leave Canada when a work permit expires, if an application for renewal via a different employer has been submitted.
Immigration lawyer Singer says the applicant is given implied status until the decision is made on the new application, provided it is submitted before the old one expires.
A key legal point is that the candidate cannot start work for the new employer until the work permit has been granted, however they do not have to leave Canada in this time.
How to apply through a provincial nomination program is also covered in this livestream video.
Immigration attorney Singer highlights the important difference between the provincial categories that are attached to Canada Express Entry, and those that are not.
For those categories specifically attached to Express Entry, the applicant needs to first create a profile before looking to achieve a provincial nomination.
For the other province-specific categories, an application must be filed directly to the province in question.
Singer advises candidates to have their applications ready to send as the various streams open and close quickly and sporadically throughout the year.
Immigration lawyer Singer also gives some valuable advice on proving physical presence when it comes to a permanent residence renewal or citizenship application.
Keeping an ongoing file of evidence, including boarding passes, hotel receipts, passport stamps and everything else, can provide a big advantage when the information is requested.
“It’s a bit of a hassle, but make it easy to access. It’s well worth the planning to avoid problems,” Singer says.
