Immigration Minister Marc Miller has established a temporary public policy to allow certain Iranian nationals to extend their stay in Canada.<\/p>\n

The killing of Mahsa Amini by the Iranian regime\u2019s so-called \u201cmorality police\u201d in September 2022 led to many Iranians coming to Canada to visit or spend time with family, work temporarily, or study.<\/p>\n

The Canadian government, in recognition of these residents\u2019 wish to prolong their stay in Canada, has thus instituted a temporary measure to make it easier to do so without fees and move between temporary resident streams.<\/p>\n

The following conditions need to be met to be granted an exemption from the provisions of the Act and Regulations:<\/p>\n

    \n
  1. The foreign national\n
      \n
    1. Is a national of Iran in Canada with valid temporary resident status; and<\/li>\n
    2. Has applied for\n
        \n
      1. an extension of their authorization to remain in Canada as a temporary resident under section 181 of the Regulations, or<\/li>\n
      2. a temporary resident permit.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n
      3. The foreign national\n
          \n
        1. Is a national of Iran in Canada with valid temporary resident status;<\/li>\n
        2. Has applied for\n
            \n
          1. an extension of their authorization to remain in Canada as a temporary resident under section 181 of the Regulations, or<\/li>\n
          2. a temporary resident permit; and<\/li>\n<\/ol>\n<\/li>\n
          3. Has applied for a work permit under section 200 or 201 of the Regulations.<\/li>\n<\/ol>\n<\/li>\n
          4. The foreign national\n
              \n
            1. Is a national of Iran in Canada with valid temporary resident status;<\/li>\n
            2. Has applied for\n
                \n
              1. an extension of their authorization to remain in Canada as a temporary resident under section 181 of the Regulations, or<\/li>\n
              2. a temporary resident permit; and<\/li>\n<\/ol>\n<\/li>\n
              3. has applied for a study permit under section 216 or 217 of the Regulations from within Canada.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

                The exemption may be granted for the following Provisions of the Regulations:<\/p>\n

                For those who meet the conditions listed in 1:<\/h3>\n
                  \n
                • Subsection 298(1)<\/b> \u2013 the requirement to pay an application processing fee for a temporary resident permit;<\/li>\n
                • Subsection 305(1)<\/b> \u2013 the requirements to pay an application processing fee for an extension of authorization to remain in Canada as a temporary resident;<\/li>\n
                • Subsection 315.1(1)<\/b> \u2013 the requirement to pay for the provision of service in relation to the collection of biometric information.<\/li>\n<\/ul>\n
