{"id":108624,"date":"2022-12-22T18:18:07","date_gmt":"2022-12-22T23:18:07","guid":{"rendered":"https:\/\/immigration.ca\/immigrant-trucker-wins-work-permit-case-against-ircc-over-lack-of-canadian-experience\/"},"modified":"2022-12-22T18:18:07","modified_gmt":"2022-12-22T23:18:07","slug":"immigrant-trucker-wins-work-permit-case-against-ircc-over-lack-of-canadian-experience","status":"publish","type":"post","link":"https:\/\/immigration.ca\/fr\/immigrant-trucker-wins-work-permit-case-against-ircc-over-lack-of-canadian-experience\/","title":{"rendered":"Immigrant Trucker Wins Work Permit Case Against IRCC Over Lack Of Canadian Experience"},"content":{"rendered":"<p>A foreign national from India has just won a ruling in federal court after taking on Immigration, Refugees and Citizenship Canada (IRCC) for refusing him a work permit due to his lack of experience driving on British Columbia roads.<\/p>\n<p>Satnam Singh, 35, had landed a job as a long-haul truck driver with Super Bee Transport in British Columbia after a positive <a href=\"https:\/\/immigration.ca\/fr\/labour-market-impact-assessments-lmias-canada\/\">Labour Market Impact Assessment<\/a> (LMIA).<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>In refusing Singh the work permit under the <a href=\"https:\/\/immigration.ca\/fr\/how-to-apply-for-canadian-temporary-work-permit\/\">Temporary Foreign Work Program<\/a> (TFWP) on Jan. 1, 2022, the IRCC officer also expressed doubt Singh could actually do the job because his experience as a driver is from the United Arab Emirates.<\/p>\n<hr \/>\n<p><b>Read More<\/b><\/p>\n<p><a href=\"https:\/\/immigration.ca\/fr\/international-experience-canada-program-to-take-20-more-applications-in-2023\/\">International Experience Canada Program To Take 20% More Applications In 2023<\/a><br \/>\n<a href=\"https:\/\/immigration.ca\/fr\/quebec-holds-the-line-on-immigration-in-caqs-latest-levels-plan\/\">Quebec Holds The Line On Immigration In CAQ\u2019s Latest Anti-Business Levels Plan<\/a><br \/>\n<a href=\"https:\/\/immigration.ca\/fr\/prince-edward-island-draw-province-issues-69-canada-immigration-invitations\/\">Prince Edward Island Draw: Province Issues 69 Canada Immigration Invitations<\/a><\/p>\n<hr \/>\n<p>\u201cI note that the applicant\u2019s work experience as a truck driver is entirely limited to the UAE, the terrain and weather conditions of which are significantly different compared to those in Canada,\u201d wrote the IRCC officer.<\/p>\n<p>\u201cI am not satisfied that (he) has demonstrated that he is able to perform the work sought in a way that does not put the safety of Canadians at risk.\u201d<\/p>\n<p>That\u2019s unreasonable, decided Justice Shirzad Ahmed.<\/p>\n<p>\u201cThe applicant also provided employment reference letters from each of the three companies he worked for, confirming his employment as a truck driver in the UAE and reflecting positively on his work performance in their respective businesses,\u201d wrote Justice Ahmed.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<hr \/>\n<p><b>Watch Video<\/b><\/p>\n<p><iframe title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/2WIqzzzTfYM\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<hr \/>\n<p>\u201cThis evidence points directly to the applicant\u2019s ability to perform the work of a truck driver in Canada, for which he has several years of positively-regarded experience. It is unreasonable for the officer to weigh the differences in weather conditions between the UAE and Canada to be determinative of his abilities.\u201d<\/p>\n<p>The court\u2019s stand on the issuance of this trucker\u2019s work permit comes as Canada is facing a massive shortage of truck drivers, a fact reflected in the country\u2019s decision in November to make this one of 16 newly-eligible occupations under the <a href=\"https:\/\/immigration.ca\/fr\/qui-peut-immigrer-au-canada-dans-le-cadre-du-programme-des-travailleurs-qualifies\/\">Federal Skilled Worker<\/a>\u00a0(FSW) program.<\/p>\n<p>The latest driver shortage survey by the IRU, an international transportation industry association based in Geneva, reveals trucker shortages are expected to jump up to 40 per cent this year.<\/p>\n<h3>Truckers Now Qualify For Permanent Residence Under The Federal Skilled Worker Program<\/h3>\n<p>\u201cChronic commercial driver shortages are getting worse, with millions of positions remaining unfilled,\u201d said IRU secretary-general Umberto de Pretto in a statement in June. \u201cThis is putting already stressed economies and communities at higher risk of inflation, social mobility issues and supply chain meltdown.\u201d<\/p>\n<p>Canadian Trucking Alliance (CTA) spokesman Jonathan Blackham has described the shortage of truckers in Canada as \u201cacute\u201d and said it poses a strain on the country\u2019s supply chain.<\/p>\n<hr \/>\n<p><b>If you are a candidate looking for a Canada job, or an employer looking to recruit foreign talent from abroad, immigration.ca can help.
