{"id":10725,"date":"2016-09-08T19:13:00","date_gmt":"2016-09-08T19:13:00","guid":{"rendered":"https:\/\/immigrationca.staging.wpengine.com\/fr\/?p=10725"},"modified":"2016-09-08T19:13:00","modified_gmt":"2016-09-08T19:13:00","slug":"report-claims-previous-changes-tfwp-leaves-migrants-vulnerable-audio","status":"publish","type":"post","link":"https:\/\/immigration.ca\/fr\/report-claims-previous-changes-tfwp-leaves-migrants-vulnerable-audio\/","title":{"rendered":"Report Claims Previous Changes to TFWP Leaves Migrants More Vulnerable (Audio)"},"content":{"rendered":"<p>Low-skilled migrant workers were left further exposed to exploitation by changes made to the <a href=\"https:\/\/immigration.ca\/canada-work-visa\/\">Temporary Foreign Worker Program<\/a> under the previous Conservative government.<\/p>\n<p>A new report by an Ontario charity concludes that the <a href=\"https:\/\/immigration.ca\/temporary-foreign-worker-overhaul-imposes-limits-hikes-inspections\/\">2014 move<\/a> to place caps on numbers of TFWs and limit how long they could stay in Canada created an atmosphere of uncertainty that played into the hands of unscrupulous employers.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" id=\"img897\" class=\"alignright\" title=\"Report Claims Previous Changes to TFWP Leaves Migrants More Vulnerable\" src=\"https:\/\/immigration.ca\/images\/pics\/ontario2.jpg\" alt=\"Low-skilled migrant workers were left further exposed to exploitation by changes made to the Temporary Foreign Worker Program under the previous Conservative government.\" width=\"401\" height=\"281\" border=\"0\" \/><\/p>\n<p>Fay Faraday, the human rights lawyer who wrote the report for the Metcalf Foundation, says the Liberal government\u2019s review of the system represents a crossroads for Canada, between viewing temporary labour as a commodity and constructing a framework to give the workers back their rights.<\/p>\n<hr \/>\n<p><img decoding=\"async\" id=\"img6954\" class=\"alignright\" title=\"Number of TFWs in Canada by Year\" src=\"https:\/\/immigration.ca\/images\/graphs\/number-of-TFW.jpg\" alt=\"Report Claims Previous Changes to TFWP Leaves Migrants More Vulnerable\" width=\"403\" height=\"221\" border=\"0\" \/><\/p>\n<p>\u201cA multi-dimensional rights-based approach is needed to build effective protection for decent work,\u201d Faraday writes.<\/p>\n<p>\u201cSuch an approach must be anchored in human rights and labour rights and it must reject the commodification of labour and be anchored in a firm commitment to worker protection.\u201d<\/p>\n<p>Campaigners have for years sought a change in the rule that ties a TFW to one employer during their time in Canada.<\/p>\n<p>With that employer holding the power to send them back to their home countries, TFWs are reluctant to raises questions over the way they are treated for fear of losing their visa.<\/p>\n<p>That leads to cases like that of Jennilyn Morris, the cleaning company owner <a href=\"https:\/\/immigration.ca\/canada-must-come-hard-employers\/\">jailed in Edmonton<\/a> for exploiting TFWs.<\/p>\n<p>When Harper\u2019s government put further restrictions in place, workers\u2019 advocates claimed it made the situation worse, according to Faraday\u2019s report, with workers having to compete for limited numbers of renewal places and the government issuing visa for only one year.<\/p>\n<p>Faraday writes: \u201cMigrant workers\u2019 insecurity is a product of choices that federal and provincial governments have made in developing the legal and policy systems that govern these workers\u2019 labour migration journey.<\/p>\n<p>\u201cTheir insecurity is an entirely foreseeable outcome of those choices.<\/p>\n<p>\u201cWith Canada\u2019s labour migration policy at a crossroads, what future will we choose?\u201d<\/p>\n<p>The report concluded with the following recommendations:<\/p>\n<ol>\n<li>Canadian immigration policy must be reframed to ensure that workers of all skill levels can apply to immigrate to Canada for permanent resident status.<\/li>\n<li>Migrant workers of all skill levels who are working in Canada should have access to secure pathways to apply for and receive permanent residence.
