{"id":64768,"date":"2019-02-14T16:16:50","date_gmt":"2019-02-14T16:16:50","guid":{"rendered":"https:\/\/immigrationca.staging.wpengine.com\/?page_id=64768"},"modified":"2019-03-04T05:08:37","modified_gmt":"2019-03-04T05:08:37","slug":"intra-company-transferees","status":"publish","type":"page","link":"https:\/\/immigration.ca\/fr\/intra-company-transferees\/","title":{"rendered":"Intra-Company Transferees"},"content":{"rendered":"<p>Intra-company transferees may apply for a Canadian work permit without the need for a <a href=\"https:\/\/immigration.ca\/labour-market-impact-assessments-lmia-in-canada\/\">Labour Market Impact Assessment (LMIA)<\/a>, which makes the process simpler, faster and cost efficient.<\/p>\n<p>This LMIA-exemption is based on the \u201csignificant economic benefit to Canada\u201d brought by the temporary transfer of qualified employees who will use their expertise to Canadian businesses.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h3>General requirements<span class=\"Apple-converted-space\">\u00a0<\/span><\/h3>\n<p>Intra-company transferees may apply for work permits without an LMIA, if they:<\/p>\n<ol>\n<li>are currently employed by a parent company that has a subsidiary, a branch, or an affiliate in Canada;<\/li>\n<li>have been employed continuously by the parent company in a similar full-time position (not accumulated part-time) for at least one year in the previous three-year period;<\/li>\n<li>are being transferred to a position in one of three categories: executive, senior manager, or worker with specialized knowledge;<\/li>\n<li>are coming to Canada for a temporary period only;<\/li>\n<li>comply with all immigration provisions for temporary work in Canada.<\/li>\n<\/ol>\n<h3>Requirements for the company<\/h3>\n<p>The parent company must secure physical premises in Canada and must have the financial ability to start its business activity and compensate its employees.<\/p>\n<p>The parent company must demonstrate a qualifying relationship with the subsidiary, the branch or the affiliate in Canada, both of them must be actively \u201cdoing business\u201d (regularly and continuously providing goods and\/or services).<\/p>\n<h3>Intra-company Transfer Categories<\/h3>\n<ol>\n<li><b><\/b><b>Executives<\/b><\/li>\n<\/ol>\n<p>Executives are employees who direct the management of the company or a major component of it, establishing goals and policies and with a large discretionary power of decision-making.<\/p>\n<ol start=\"2\">\n<li><b><\/b><b>Senior managers<\/b><\/li>\n<\/ol>\n<p>Senior managers are employees who primarily manage the company, a department or a component, and also supervise and control the work of other managers and employees. They have authority to manage human, financial and\/or material resources.<\/p>\n<ol start=\"3\">\n<li><b><\/b><b>Workers with specialized knowledge<\/b><\/li>\n<\/ol>\n<p>Applicants under this category must demonstrate that they possess a high standard of \u201cspecialized knowledge\u201d or a \u201cknowledge at an advanced level of expertise\u201d, related to the company\u2019s product or services.<\/p>\n<h3>Duration of work permits<\/h3>\n<p>The initial work permit can be issued for one year only, but it is renewable.<\/p>\n<p>For renewals, evidence must be provided that:<\/p>\n<ul>\n<li>the parent foreign company still has a qualifying relationship with the Canadian subsidiary, branch or affiliate;<\/li>\n<li>the new office has engaged in the continuous provision of goods or services for the past year;<\/li>\n<li>the new office has been staffed.<\/li>\n<\/ul>\n<p><b>Interested employers:\u00a0<\/b>Kindly\u00a0<a href=\"https:\/\/immigration.ca\/en\/employment-portal\/canada-employers.html\">contact us<\/a>\u00a0here to receive further information.<\/p>\n<p><b>Interested candidates:<\/b>\u00a0Find out whether you qualify to Canada by completing our\u00a0<a href=\"https:\/\/immigration.ca\/en\/free-immigration-evaluation.html\">free on-line evaluation<\/a>.
